Yes, anyone can be partner in partnership firm if such person is an employee of any company. But one should check the employment contract before taking any step because if it includes any clause against to carry on similar business or becoming a partner then it will be considered breach of clause. The company can take steps against such person.

For the registration of an LLP the certification from CA/CS or lawyer is mandatory. Hence it is not possible to register an LLP without consulting the professional. What is the process of reviving a trademark in abandoned status?

The trademark gets abandoned when Trademark Ministry raises any query or notices and the reply to the same has not been filed. In any such situations after the expiry of the provided time limit, Ministry issues notice for abandonment. Normally the abandoned trademarks are not revived. But in case if it is proved that the abandonment will cause the huge loss to the proprietor then Ministry may revive the trademark if it thinks fit. Proprietor also needs to show causes why the reply to the notice has not been filed in the prescribed time period.

Partnership Act has not provided any limit for the maximum number of Partners. But according to Companies Act 2013, the maximum number of partners allowed for any business activities is 50. If in any case the number of members increases the limit than such entity must be registered as company under Companies Act 2013.

What remedy does a registered trademark owner have if he fails to oppose the registration of the same trademark by somebody else?

Basically before registration of any trademark, Ministry issues notices for 120 days for opposition. In such period any 3rd party can oppose the said mark to prevent that brand name from registration. However if someone has failed to oppose the trademark in the given period then one has two options either file form for Cancellation/Rectification of trademark or can file a suit for trademark infringement.
