The trademark gets abandoned when Trademark Ministry raises any query or notices and the reply to the same has not been filed. In any such situations after the expiry of the provided time limit, Ministry issues notice for abandonment. Normally the abandoned trademarks are not revived. But in case if it is proved that the abandonment will cause the huge loss to the proprietor then Ministry may revive the trademark if it thinks fit. Proprietor also needs to show causes why the reply to the notice has not been filed in the prescribed time period. For revival of trademark an application is to be filed with the Ministry with all reasons and proofs as mentioned earlier.
