What is the validity of a trademark?

Submitted by LegalWizin on Tue, 10/27/2020 - 02:49

A trademark once registered is valid for a period of 10 years from the Date of APPLICATION. Please note that the validity period is not counted from the date of registration certificate but from the date of filing of trademark application.

Unlike other IPs (Patent or Copyright), the protection is further extendable for a further period of 10 years at a time. A renewal application is made to Trademark Registry.

The applicant may apply for TM renewal before 1 years of expiry date or within 6 months from expiry. The renewal fee will be payable as applicable.
