What are the basic features of trademark protection at International level?

Trademark registration is territorial in nature. If you register a trademark in India, you can claim exclusive rights over it only in India. If you plan to expand and sell in foreign countries, a separate trademark application is required to be filed in each country you wish to avail trademark registration. However, it is mandatory for the trademark to be registered in home country before filing for its international registration application.

India is the party of the Madrid protocol which is a cost effective and easier way to file and manage international trademark applications. Through one application, you can file trademarks in 119 countries around the world. The application must be submitted to your Office of origin, which will check that it corresponds with the particulars of your basic mark, certify the international application, and then submit it to WIPO. The fees for application vary based on countries selected for registration.
