The best
candidates in the industry are desired to be hired by any organization, but who
is the best is something quite tricky to decide.

Organizations
before hiring employees, conduct specific tests. These tests cover the checking
of commercial, personal and criminal data of a candidate. It is also known as
an employment background check.
It is vital both for prospective job seekers and employers to understand the
parameters of background checking.

Process of
background checking

A job seeker
makes an application for the vacancy, and the company conducts the background
check. Once done, the hiring authority must inform you about this testing in
writing. But these days, organizations prefer to get the background checking
done by 3rd party firms specialized in the profile. In such a scenario, the
company needs to have written authorization from the job applicant to conduct
the test.

Once you give
written authorization then only, they will conduct the test. Such as the
employer does not have any right to call your previous employer without your
consent. In general, based on the reports of these agencies, the companies
decide on hiring a person.

In case
if a company does not want to hire you, then they must inform you by providing
a pre-adverse action disclosure. This disclosure will include the consumer
report and will explain your right too. The company must give you the adverse
action notice where the details of the company that conducted the employment
background check
 are mentioned.

Facts that
employer can check

The
background checking process of an employee starts with the verification of
social security numbers like PAN in India and extends to a thorough checking of
the history. Work history, credit history, driving records, and criminal cases,
etc. are checked. Besides this, there are other areas such as bankruptcy,
medical records, other court cases which can also be checked, by the employers.

Before hiring
an employee, the employer can also conduct a character check before they opt to
hire the candidate. But, normally, the employer will check the background of an
employee related to the job only. Suppose if you are applying for a vacancy
with any bank, then the employers will check whether you have any record of
embezzlement or theft.

Facts which
employees are not permitted to check

There are
certain facts that an employer cannot check. These are

  • Record of bankruptcy after 10 years
  • Any civil cases or arrest more than 7 years
    back

But these
restrictions do not apply to the areas where salary is at a higher range and
the profile is of higher responsibility.

Apart from
those above, the employer cannot check the school records without your consent.
If you are engaged in military services, then the confidential facts, cannot be
released other than in certain circumstances with written permission from the
candidate. Well, if you are aware that an employment background check will be conducted on you, then
you need to stay prepared for that. You should be aware of the facts that the
employer might discover. Be true, to the employer in the interview as that will
help you to qualify in the test.
