What is the easy way to register a trademark online?

Trademark registration process in India can be easily done online, using the e-filing services. These are the steps that one needs to follow to get their trademark registered

Trademark search

The first step would be to conduct a Trademark search, it should be done before filing an application to ensure that there are no similar trademark applications that can conflict with your brand name. This search can be made on the official government

website: http://ipindiaonline.gov.in/tmrpublicsearch/frmmain.aspx.

Filing the TM application

After the search is done and there are no similar brand names that are registered or applied then one can proceed with the filing process. It is better if you consult a trademark attorney or a professional to help you with the filing.

It is important that the application is filed in an appropriate manner and within a correct jurisdiction. Once the application will be filed you will receive a receipt from the trademark registry on the portal itself acknowledging that your application is successfully filed.

TM examination

After the application is done the registrar would examine the application along with the supporting documents. The application is examined and accepted if it is without any issues relating to its distinctiveness and registrability. If it is not accepted the examiner would mention the issues in the examiner’s report and the applicant is given a months’ time to resolve and respond to the objection.

Trademark Opposition

After it is accepted, it is published in the Trademarks Journal. Here the mark is open to receiving any opposition from a third party or individual who wants to oppose the registration of the mark. If the mark is not opposed within 3-4 months from the date of publication the trademark application goes to the next stage. If someone opposes a fair hearing will be conducted and a decision is given by the Registrar.

Registration

Trademark hence proceeds and is finally registered. A registered trademark symbol (®) can be used once the certificate is received by the applicant. It usually takes 15-18 months for a trademark to get registered.
