What are the Requirements for Filing a Trademark Application

The name, address and nationality of the candidate. On the off chance that the candidate is a partnership firm, the names of the considerable number of partners. Also, say whether any minor is an accomplice.

Case - 1: If the candidate is a company, the country or state of incorporation.

A list of goods and services for which registration is required.

• Soft copy of the trademark which is to be registered.

• If the mark contains or consists of non-English words, a translation of those words into English is required.

• If the application is to assert need from a prior recorded tradition application, details of that application is also required (application number, filing date, country and goods/services).
An ensured need document or its duly legally approved duplicate is to be submitted.
• On the off chance that the endorsement is not in English, a confirmed/legally approved English translation is also required.

• On the off chance that it is not promptly accessible, the application can be recorded based on the basic application number, date of the application and country of the application. A duplicate of the need document can be submitted within one month from the filing date of the application.

• Date of first use of the trademark in India, if at all used

POA of lawyer simply signed by the candidate (no legalisation or authentication is required). For Indian clients, POA has to be executed in 100 Rs. Stamp paper and signed by the candidate. The POA is not required at the time of lodging the application and can be submitted later with no extra cost.
